These terms govern your use of Balvira, the gym and akhara management software published at balvira.in. They apply from the moment you open an account, and they sit alongside the Customer Agreement, the Privacy Policy and the Refund and Cancellation Policy.
The service
Balvira is software for running a gym, akhara, boxing club or studio: members and memberships, attendance and check-in, fees and invoices, classes, coaching, inventory, reminders and reports. It is delivered over the internet and is not sold as a copy you install. We add to it and change it, and we may retire a feature that is not used — where doing so would materially reduce what you are paying for, we will tell the account holder first.
Who may open an account
Anyone aged 18 or over who is entitled to enter into a contract in India, acting for a business that trains people. One person is the account holder and holds the owner login; that login can create every other login and is the only one that can close the account.
Using it properly
You may use Balvira for your own business. You may not resell it, rent it out, or run somebody else's gym on your account and call it a branch of yours. You may not reverse-engineer it, scrape it, or automate against it in a way that degrades it for anyone else. Automated access for your own integration is fine — write to us and we will tell you how.
- One account is one business, however many branches it has
- No sending marketing messages to people who have not opted in
- No storing data about somebody that you had no right to collect
- No attempt to reach a tenant that is not yours
Messages sent through Balvira
Reminders, receipts and notices go out under your name, from your own WhatsApp Business number through your own provider account, or from your own email settings. The content is yours and so is the responsibility for it, including consent under India's telecom and data protection rules. Balvira supplies the mechanism and does not review what you send.
Fees, tax and the money your members pay
Subscription prices are published on the pricing page in Indian rupees, inclusive of tax where tax applies. Your subscription invoice names Balvira as the seller and carries our registration where we hold one. Fees collected from your own members are separate: online payments settle directly into your own Razorpay or Cashfree account, cash is recorded in your own ledger, and Balvira takes no share of either.
Suspension and closure
We may suspend an account for non-payment after the paid period has ended, or immediately where it is being used unlawfully or in a way that threatens the platform or another customer. A suspended account is not deleted: the data stays and comes back when the reason does. We will give notice before suspending for non-payment.
Your data on the way out
Your account can export its own records at any time while it is open, and we would rather you left with your data than argued with us for it. After an account is closed we keep the data for ninety days in case it was a mistake, then delete it, other than what we must keep for tax and accounting.
Availability, and the limits of what we owe
We work to keep Balvira available and we do not publish an uptime guarantee, because we are not yet in a position to stand behind one. The service is provided as it is. To the extent the law allows, Balvira's total liability to you for anything arising out of these terms is limited to the subscription fees you paid us in the twelve months before the claim, and we are not liable for lost profit, lost business or lost data beyond that.
Governing law
Indian law governs these terms. The courts at Jhajjar, Haryana have exclusive jurisdiction. Before either of us goes near a court, we each agree to put the complaint in writing to the other and give thirty days to answer it.
